Boating Accidents

BARELY TREADING WATER AND IN NEED OF A LIFE RAFT?

Stop Being Polite... GET RUDE

Wiped Out While on the Water? GET RUDE to Get Help.

Getting on a boat is supposed to be fun: a chance to fish, go tubing, or  water ski. But just like any mode of transportation, accidents can and do occur. And it just takes one negligent person to ruin a good time on a boat.

Whether you’re in Louisiana, Texas, or anywhere else in the country, RUDIN LAW is ready to take on those responsible for your boating injuries and get you the justice and compensation you deserve. So if you’ve been hurt on a boat, we say: it’s time to stop being polite… and GET RUDE.

Types and Causes of Boating Accidents

Boating accidents can occur in many different ways:

  • Boat Collisions: Involving two or more boats.
  • Impact with Structures: Collisions with fixed objects or docks.
  • Capsizing: When a boat overturns in the water.
  • Grounding: Running aground on the seabed or shore.
  • Water Skiing Accidents: Incidents occurring while water skiing.
  • Kayak Incidents: Accidents involving kayaks.
  • Jet Ski Crashes: Accidents involving Jet Skis or other personal watercraft.

Despite measures in place designed to protect boaters, accidents can still occur for reasons similar to those that cause car crashes, such as:

  • Operator Negligence
  • Operator Inexperience
  • Speeding
  • Alcohol or Drug Impairment
  • Equipment Failure
  • Poor Weather Conditions
  • Navigational Rules Violations

Boat Accident Statistics

Boating accidents can differ from other accidents due to the interplay between the accident and marine specific laws and insurance policies. And available safety data reveals the gravity of boating risks and the consequences of water-based accidents.
Louisiana: According to the Louisiana Department of Wildlife and Fisheries, the number of boating crash incidents reached 162 in 2020, up from 135 boating incidents in 2019 which was up from 129 boating incidents in 2018. The number of boating fatalities also rose from 19 in 2018 to 20 in 2019 and up to 24 in 2020. This spike underscores the potential for severe outcomes in such incidents across the state.

Texas: According to the Texas Parks & Wildlife Department, in 2019, the Coast Guard counted 4,168 recreational boating accidents that involved 613 deaths, 2,559 injuries and approximately $55 million dollars of damage to property.

Don’t Delay! Be Wary of the Deadline to File Your Lawsuit

There are many factors that determine the deadline by which you must file your boating accident lawsuit. The deadline to file will depend upon whether your claim falls under state or federal jurisdiction. Because the governing law is complex, it would be impossible to determine if your deadline has passed without speaking to a qualified attorney – and we highly recommend you do so.

Get Hurt? Get Help.
